TERMS OF SERVICE
OVERVIEW
Welcome to Hybrid Herbs. The terms "we", "us" and "our" refer to Hybrid Herbs. Hybrid Herbs operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Hybrid Herbs is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Nothing in these Terms of Service affects your statutory rights as a consumer.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country or jurisdiction of residence, or that you have the permission of a parent or legal guardian where required by applicable law.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You represent that the information you provide to us is correct, current and complete and that you have the necessary right to provide this information.
You are responsible for maintaining the security of your account credentials and for activity carried out through your account. You may not transfer, sell, assign or license your account to another person.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to provide accurate representations and descriptions of our products and services in our online store. However, colours and product appearance may vary slightly from how they appear on your screen due to the device and display settings you use.
Product packaging, labels or presentation may occasionally change, including during transitions between packaging designs. We take reasonable steps to ensure that material product information remains accurate.
All descriptions of products are subject to change where reasonably necessary. We reserve the right to discontinue a product at any time and may limit quantities or availability in particular geographic regions or jurisdictions where appropriate.
Nothing in this section affects your statutory rights, including your rights where goods are faulty, not as described or otherwise do not conform to applicable consumer law.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Hybrid Herbs reserves the right to accept or decline an order where we have a legitimate reason to do so.
Your order is not accepted until Hybrid Herbs confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting it. If you wish to change or cancel an order, please contact us as soon as possible. If an order has already entered fulfilment or been dispatched, we may be unable to stop it, but this does not affect any statutory cancellation or return rights that apply to you.
If we do not accept, make a material change to, or cancel an order, we will attempt to notify you using the email address, billing address and/or telephone number provided when the order was placed.
Your purchases are subject to our Returns & Refunds Policy, which explains your cancellation and return rights, how to make a return and how refunds are handled.
UK consumers purchasing online generally have the right to cancel eligible purchases within 14 days of receiving the goods. Certain exceptions may apply, as explained in our Returns & Refunds Policy.
You represent that purchases made through our consumer online store are for lawful purposes. If you wish to purchase products for commercial resale or wholesale purposes, please contact us.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price displayed when your order is placed and will be set out in your order confirmation.
Applicable delivery charges will be displayed during checkout before you complete your purchase.
For international orders, additional customs duties, import taxes or other charges may be imposed by the destination country. Unless expressly stated otherwise at checkout, these charges are the responsibility of the recipient.
Prices offered through our online store may differ from prices offered by third-party retailers or at physical events or locations.
We may offer promotions from time to time that are governed by additional terms and conditions. If specific promotional terms conflict with these Terms in relation to that promotion, the promotional terms will apply to the extent permitted by law.
You agree to provide current, complete and accurate purchase, payment and account information and to update relevant information where necessary so that we can complete your transactions and contact you as required.
You represent that you are authorised to use the payment method provided for your purchase.
SECTION 5 - SHIPPING AND DELIVERY
Available delivery methods, charges and estimated delivery times are displayed on our website and/or during checkout.
Delivery times are estimates unless we expressly agree otherwise. Occasionally, deliveries may be affected by circumstances outside our reasonable control, including carrier disruption, customs processing, severe weather or other unforeseen events.
We will take reasonable steps to fulfil and deliver orders within the timescales stated or otherwise agreed with you.
For UK consumer orders, unless a different delivery period has been agreed, goods will be delivered without undue delay and normally within 30 days of the contract being entered into.
For consumer orders, responsibility for the goods generally remains with us until the goods come into the physical possession of you, or a person identified by you to receive them, except where you independently arrange a carrier that was not offered by us.
International delivery times may be affected by customs procedures and local delivery services outside our direct control.
Customers are responsible for providing an accurate and complete delivery address. If you notice an error in your delivery details, please contact us as soon as possible.
Please see our Shipping Policy for further information about delivery.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to our trademarks, branding, text, displays, images, graphics, photographs, video, audio and the design, selection and arrangement of such content, are owned by Hybrid Herbs, its affiliates or licensors where applicable and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit material from the Services for commercial purposes without our prior written consent, except where permitted by law.
Except as expressly provided, nothing in these Terms grants you a licence or other rights to intellectual property belonging to Hybrid Herbs, Shopify or any third party.
Hybrid Herbs' names, logos, product and service names, designs and slogans may be trademarks or other protected intellectual property of Hybrid Herbs or its licensors and must not be used without appropriate permission.
Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. Other names, logos and trademarks appearing through the Services belong to their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to tools offered by third parties as part of the Services, which we may neither monitor nor control.
Such third-party tools may be provided "as is" and "as available" and may be subject to the relevant provider's own terms and conditions.
Any use by you of optional tools offered through the site is at your discretion, and you should ensure that you understand the terms on which those tools are provided.
We may also offer new features through the Services in the future. Such features will also be considered part of the Services and subject to these Terms where applicable.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party functionality.
We are not responsible for the content, accuracy, availability or practices of independent third-party websites.
If you choose to access third-party websites, please review their policies and terms before entering into transactions with them.
Complaints, claims or questions relating specifically to products or services purchased directly from an independent third party should generally be directed to that third party.
Nothing in this section excludes or limits any responsibility that cannot lawfully be excluded or limited.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Hybrid Herbs is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Hybrid Herbs.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Hybrid Herbs, including any injury, damage or loss resulting from purchased products and services.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages and liabilities arising directly from purchases and transactions made with Hybrid Herbs.
Nothing in this section affects any rights you may have that cannot lawfully be excluded.
SECTION 10 - PRIVACY POLICY
Personal information that we collect through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, Shopify also processes certain personal information in connection with your access to and use of the Services in order to provide its platform and related services.
Certain personal information may therefore be processed by Shopify and other service providers, including providers located outside the country in which you reside, subject to applicable data protection requirements.
Please review our Privacy Policy for further information about how Hybrid Herbs collects, uses and protects your personal information and the third parties with whom information may be shared.
Shopify's own privacy information is also available through Shopify's website.
SECTION 11 - FEEDBACK
If you submit, upload, post, email or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans or other content ("Feedback"), you confirm that you have the necessary rights to provide that Feedback.
Where permitted by applicable law, you grant us permission to use, reproduce, publish, distribute and display Feedback for purposes connected with operating, improving and promoting our Services and business.
You represent that any Feedback you provide will not violate the rights of another person, including intellectual property, privacy or other legal rights, and will not contain unlawful, abusive or malicious content or computer malware.
Where applicable, you should disclose compensation or incentives received in connection with a review or other Feedback.
We may moderate, edit or remove Feedback where we reasonably consider it unlawful, offensive, defamatory, infringing, misleading or otherwise inappropriate.
You are responsible for the accuracy of Feedback that you provide.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services containing typographical errors, inaccuracies or omissions relating to matters such as product descriptions, pricing, promotions, offers, shipping charges, transit times and availability.
We reserve the right to correct errors, inaccuracies or omissions and to update information where reasonably necessary.
If an error materially affects an order you have already placed, we will deal with the matter fairly and in accordance with applicable consumer law.
Nothing in this section affects your statutory rights.

You may access and use the Services for lawful purposes only.
You may not access or use the Services, directly or indirectly:

We reserve the right to suspend or terminate access where we reasonably determine that these Terms have been materially violated.
SECTION 14 - AGENTS
14.1 This section ("Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any Services. "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity.
14.2 No Agent may access, use or interact with the Services where we have expressly requested that the Agent refrain from doing so or where such access circumvents restrictions that we have implemented.
14.3 We may use reasonable technical measures to control whether and how Agents access, use and interact with the Services.
14.4 Agents must not conceal or deliberately misrepresent the automated nature of their access, circumvent CAPTCHAs or other measures designed to distinguish automated from human access, or circumvent measures intended to block, limit or control automated access to the Services.
SECTION 15 - TERMINATION
We may suspend or terminate your access to the Services, or any part of them, where we reasonably consider this necessary because of a material breach of these Terms, unlawful activity, security concerns or misuse of the Services.
You remain responsible for amounts properly due in connection with purchases made before termination.
Sections that by their nature should continue following termination, including provisions concerning intellectual property, privacy, liability and governing law, will continue to apply where appropriate.
SECTION 16 - DISCLAIMER OF WARRANTIES
Information presented on or through the Services is provided primarily for general informational purposes.
While we take reasonable care over information provided on the website, nothing on the website should be regarded as a substitute for professional medical or other professional advice where such advice is appropriate.
We do not guarantee that access to our website will always be uninterrupted, timely, secure or error-free.
Nothing in these Terms excludes or restricts warranties, guarantees, remedies or other rights that cannot lawfully be excluded or restricted, including your statutory rights as a consumer in relation to products purchased from us.
SECTION 17 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot otherwise be excluded under applicable consumer law.
Nothing in these Terms limits your statutory rights in relation to goods that are faulty, not as described or otherwise fail to meet applicable legal requirements.
To the fullest extent permitted by applicable law, Hybrid Herbs will not be responsible for losses that were not reasonably foreseeable when the relevant contract was entered into.
Where you purchase products as a consumer, we are not responsible for business losses arising from use of products for commercial or resale purposes.
SECTION 18 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for losses reasonably incurred by Hybrid Herbs, Shopify or their respective affiliates, employees, contractors or service providers as a direct result of your unlawful use of the Services or your material breach of these Terms.
Nothing in this section limits rights or protections that you have under applicable consumer law.
SECTION 19 - SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed severed from these Terms.
Such determination will not affect the validity and enforceability of the remaining provisions.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce a right or provision of these Terms of Service does not constitute a waiver of that right or provision.
These Terms of Service, together with the policies or operating rules posted by us on this site and expressly incorporated into these Terms, constitute the agreement between you and us concerning your use of the Services and purchases made through our website.
Nothing in these Terms removes or limits any statutory consumer rights or other rights that cannot lawfully be excluded.
SECTION 21 - ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms where doing so would materially affect our rights or obligations without our prior written consent.
We may transfer or assign our rights and obligations under these Terms where reasonably necessary in connection with our business, provided that doing so does not reduce your statutory rights.
SECTION 22 - GOVERNING LAW
These Terms of Service and any contracts between you and Hybrid Herbs are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you.
If you are a consumer living elsewhere in the United Kingdom or another country, you may also be entitled to the protection of mandatory laws applicable in your place of residence.
Nothing in these Terms prevents you from exercising any right to bring proceedings in a court available to you under applicable consumer law.
SECTION 23 - HEADINGS
The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.
